The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that up to 14 days after receiving the food products we send you, in most cases, you can change your mind and get a full refund. However, perishable goods are a complicated case as they might not make it to the 14 days-after-purchase limit under the Consumer Contacts Regulations, let alone the 30-day limit of the Consumer Rights Act.
Under these circumstances, returns are not accepted due to the perishable nature of the goods and food safety precautions.
The Consumer Rights Act 2015 says food product must be as described, fit for purpose and of satisfactory quality. If the food product is faulty, then you can get a refund.

Ordering food products from us
Below, we set out how a legally binding contract between you and us is made.
You place an order on the site by means of our checkout process. Please read and check your order carefully before submitting it. However, if you need to correct any errors you can do so before submitting it to us.
When you place your order at the end of the online checkout process (when you click on the payment button), we will acknowledge it by email. This acknowledgement does not, however, mean that your order has been accepted.
We may contact you to say that we do not accept your order. This is typically for the following reasons:
the food product is unavailable;
we cannot authorise your payment;
we are unable to ship the food product to you;
you have ordered too many items of food product; or
there has been a mistake on the pricing or description of the food product.
We will only accept your order when we email you to confirm this (Confirmation Email). At this point:
a legally binding contract will be in place between you and us; and
we will dispatch the food product to you.
If you are under the age of 18 you may not buy any food product from the site.

Returns are not accepted due to the perishable nature of the goods and food safety precautions. However, a full refund will be offered in cases where:
You cancel your order before we have dispatched the product(s).
We are unable to deliver the product(s) within 14 days of your order being placed. We would inform you as soon as possible and you will be entitled to obtain a full refund or credit for any sum that has been paid by you or debited from your credit card for the food product.
An item does not conform to specification.
You must notify us of non-conformity within 24 hours of delivery for a refund to be considered.
Photographic evidence of the non-conformity will be required.
Please contact within 24hrs of receiving your order and state the information listed below when reporting any instance of non-conformity.

Should a non-conformity come to your attention after 24 hrs since delivery, please contact us immediately and it will be dealt with on a case by case basis.
Because we use independent contractors to deliver our food products, we will not be liable for any loss or damage suffered by you through any delay in delivery. If something happens which is outside of our control; and affects the estimated date of delivery, we will let you know as soon as possible and give you a revised estimated date for delivery.
When delivery has been made, you are responsible for the food product and we take no responsibility for the quality of the product if you choose not to store them in the conditions advised.
‘All our food products are frozen on the day of production and your food items are taken from frozen stock. They are completely safe to refreeze on receipt of delivery for up to 2 months if you wish.
All our cakes are suitable for home freezing. Our products are to be kept refrigerated, and consumed within 7 days of defrosting.’

We use independent contractors to deliver our food product. If you want to see your delivery options, visit our Terms of Supply and refer to Delivery and Returns webpage before you place your order.
We only accept orders for delivery to the United Kingdom.
Every effort will be made to deliver the food product as soon as possible after your order has been accepted, and in any event within 14 days of your order. If we are unable to deliver the food product within 14 days of your order, we will inform you as soon as possible and you will be entitled to cancel the order and obtain a refund or credit for any sum that has been paid by you or debited from your credit card for the food product. We will not be liable for any loss or damage suffered by you through any delay in delivery.
If something happens which:
is outside of our control; and affects the estimated date of delivery we will let you have a revised estimated date for delivery of the food product.
Delivery of the food product will take place when we deliver it to the address that you gave to us when you placed your order.
Unless you and we agree otherwise, if we cannot deliver your food product within 14 days, we will:
let you know; cancel your order; and give you a full refund.
We use Stripe, a third party payment processor, to take payment and process any refunds. In the absence of negligence on our part we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.
Your credit card or debit card will be charged when you click on the payment button during the payment process.
If your payment is not received by us and you have already received the food product, you:
must pay for the food product within 7 days; or
must return it to us as soon as possible.
If so, you must keep the food product in your possession, take reasonable care of it (including ensuring that you follow any instructions or manuals given with the food product) and not use it before you return it to us.
Nothing in this clause affects your legal rights to cancel the contract during the ‘cooling off’ period under Clauses 4 and 5.
The price of the food product: is in pounds sterling (£)(GBP);
includes VAT at the applicable rate; and does not include the cost of delivering the food product, which we will notify to you at the time you place your order.
We do not store payment card details.
Nature of the food product
The Consumer Rights Act 2015 gives you certain legal rights (also known as ‘statutory rights’), for example, the food product:
are of satisfactory quality; are fit for purpose; and match the description.
We must provide you with food products that comply with your legal rights.
The packaging of the food product may be different from that shown on the site.
While we try to make sure that:
All weights, sizes and measurements set out on the site are as accurate as possible, there may be a small tolerance of up to 3% in our sizes, weights and quantities in our food products.
The colours of our food products are displayed accurately on the site, the actual colours that you see on your computer may vary depending on the monitor that you use.
Our policy is to improve our food products continually, and so we reserve the right to make minor technical changes to the specification of the food product without affecting its function, quality or price.
Faulty food products

End of the contract
If this contract is ended it will not affect our right to receive any money which you owe to us under this contract.
Limit on our responsibility to you
Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury), we are not legally responsible for any losses that:
were not foreseeable to you and us when the contract was formed;
that were not caused by any breach on our part;
business losses; or
losses to non-consumers.
We will try to resolve any disputes with you quickly and efficiently.
If you are unhappy with:
the food product;
our service to you; or
any other matter
please contact us as soon as possible.
If you and we cannot resolve a dispute using our internal complaint handling procedure, we will:
let you know that we cannot settle the dispute with you; and

Subject to clause 12.5, these terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts. If you live in Scotland, you can bring legal proceedings in respect of the products in either the Scottish or the English courts. If you live in Northern Ireland, you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
You remain protected by any overriding mandatory provisions of law applicable to your purchase. Nothing in these terms is intended to affect any protection provided to you under any such law.
Third party rights
No one other than a party to this contract has any right to enforce any term of this contract.
